1. Fair Use
ColorBuk is provided for lawful and fair use only. Any misuse of the platform, including attempts to exploit its features in unintended ways, is strictly prohibited.
2. No Prompt Injection
Users may not engage in prompt injection or any other method of manipulating the system to produce unintended outputs or bypass content restrictions.
3. User-Generated Content
Users are responsible for any content they create, upload, or share on ColorBuk. By using the platform/uploading content/writing a prompt, you affirm that you have the necessary rights and permissions to do so. We do not claim ownership of user-generated content but reserve the right to remove any content that violates these terms.
By submitting content to ColorBuk, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, publish, adapt, modify, and otherwise exploit such content for any purpose, including for promoting and redistributing part or all of the service in any media formats and through any media channels.
4. Commercial Use Rights
Only users subscribed to the Wizard plan are permitted to use the content generated through ColorBuk for commercial purposes. Users on other plans may only use generated content for personal, non-commercial use. Commercial use includes, but is not limited to, selling products featuring the generated content, using content in commercial publications, or incorporating content into products or services that generate revenue.
5. Prohibited Content
Users may not create, upload, or share content that:
- Contains adult or sensitive material.
- Includes illegal, obscene, or otherwise prohibited content under applicable laws.
- Infringes on intellectual property rights, including copyrights and trademarks.
- Promotes violence, hate speech, discrimination, or harassment.
6. Enforcement and Termination
ColorBuk reserves the right to remove any content and terminate user access at its sole discretion if these Terms of Service are violated. We may also delete content that is deemed inappropriate or harmful without prior notice.
7. Disclaimer of Warranties
ColorBuk is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the platform will be error-free, secure, or uninterrupted. Your use of ColorBuk is at your own risk.
8. Limitation of Liability
To the fullest extent permitted by law, ColorBuk and its affiliates, officers, employees, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform, even if we have been advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold harmless ColorBuk and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.
10. Changes to These Terms
We may update these Terms of Service at any time. Continued use of ColorBuk after changes are posted constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of New Delhi, India without regard to its conflict of law principles.
